اخلاق زیستی و ART از دیدگاه اسلام (اهل سنت) و قوانین موجود در آلمان

Descriptive
اخلاق زيستي طي دو دهه گذشته شاهد معرفي شدن (سكولاريزاسيون) بوده است و در اين ارتباط متعاقباً نفوذ افكار مذهبي در اخلاق زيستي كاهش يافته است. اخلاق زيستي امروزه ديگر همانند سابق تحت اقتدار مذهب و پزشكي سنتي قرار ندارد. متأسفانه اين مبحث تحت غلبه بيشتري از مفاهيم فلسفي، اجتماعي و قانوني قرار گرفته است. در ممالك اسلامي دين هنوز تأثير بسزايي در جنبههاي مختلف رفتاري، كرداري و سياسي مردم دارد. از آنجا كه علم بدون اعتقاد، مخرب روح انساني است، بنابراين تعجبي ندارد كه همواره شاهد تعامل و ارتباط متقابل علم و دين از آغاز تاريخ بشريت با يكديگر باشيم. قرآن كريم مردم را به ازدواج، تشكيل خانواده و ازدياد نسل ترغيب كرده است. آيهاي از قرآن ميفرمايد: ما رسولان خود را فرستاديم و قبل از آن همسر و فرزندان را براي آنان مقرر كرديم.( قرآن كريم سوره رعد آيه 38). آيه ديگري ميفرمايد: و خداوند براي شما همدمهايي از جنس خودتان آفريد و به واسطه وصلت شما، پسران و دختران و نوهها را موجودي بخشيد و براي شما از بهترينها روزي مقرر فرمود (قرآن كريم سوره نحل آيه 72). در مورد ناباروري در بين زوجين خداوند ميفرمايد: خداوند دختر و پسر را به هر كه بخواهد ارزاني ميدارد و عقيم ميگذارد هر كس را اراده فرمايد (قرآن كريم سوره شورا آيه50-49). پيشرفتهاي صورت پذيرفته در تكنولوژي توليد مثل و لقاح خارج رحمي، جدا ساختن رابطه جنسي از توليد مثل را ممكن ساخته است. اين پيشرفتها زنان را قادر ساخته است تا بتوانند بدون داشتن رابطه جنسي از طريق طبيعي و يا لقاح آزمايشگاهي حامله شوند. همچنين در ادامه اين روش هاي درماني، امكان استفاده از باروري شخص ثالث از طريق تخمك، اسپرم و يا رحم ديگري فراهم آمده است. دستورالعملهاي اصلي باروري كمكي يا لقاح خارج از رحمي از ديدگاه اهل سنت در جهان اسلام، عبارتند از اين كه: انجام Assisted Reproductive Technology) ART) براي زوجين و به عنوان يك روش درماني تنها در زماني مقدور خواهد بود كه عقد ازدواج آنان اعتبار قانوني داشته و فقط از گامت زوجين در تشكيل جنين استفاده گردد. قرارداد ازدواج به واسطه طلاق يا مرگ همسر باطل مي گردد و لذا استفاده از گامت همسر متوفي يا مطلقه ممنوع است. اهل سنت اهداي اسپرم و تخمك را به جهت اختلاط نسل ممنوع ميدانند. سابقاً فتوايي وجود داشت كه اهداي تخمك يا جنين را در خانوادهاي كه مرد، دو همسر و يا بيشتر داشت (Bigamy) مجاز ميدانست. در حالي كه اكنون اين فتوا تغيير يافته است و امكان جابجايي گامت از همسران متعدد يك فرد نيز مجاز نيست. از سال 1991 در آلمان قانوني تصويب شد كه به كارگيري روشهاي كمك باروري را قانونمند نمود. اين قانون اهداي تخمك و جنين را مجاز ندانسته، در حالي كه استفاده از اهداي اسپرم مجاز شناخته شد. اهداي تخمك و جنين صرفاً به دليل مشكلات قانوني احتمالي متعاقب آن مردود دانسته شده است. اين محدوديتها فقط جنبه قانوني داشته و بر مبناي اصول ديني يا اخلاقي نيست.</span>
Objective(s): The last two decades have witnessed the secularization of bioethics. The religious influence on bioethics subsequently declined. Bioethics today is no longer dominated by religion and medical traditions as it used to be in the past. Unfortunately, it has become dominated more by philosophical, social and legal concepts. In the Islamic countries, religion still influences a lot of behaviors, practices and policies. Science without conscience ruins the soul. It is therefore not surprising that science and religion have been interrelated since the beginning of human history. The Holy Quraan encouraged marriage, family formation and reproduction. The Verse says: “We did send apostles, before thee, and appointed for them wives and children (Sura Al Ra´d, 13:38, Holy Quraan). Another Verse says: “And Allah has made for you mates of your own nature, and made for you, out of them, sons and daughters and grandchildren, and provided for you sustenance of the best (Sura Al-Nahl, 16:27, Holy Quraan). <br>Regarding infertility among many couples it says: “He bestows (children) male and female, according to His will (and Plan), or He bestows both males and females, and He leaves barren whom He will (Sura Al-Shura, 42:49-50, Holy Quraan).<br>Through the advances in assisted reproduction, it became possible to separate the bonding of reproduction from sexual act. These advances enabled women to conceive without having sex, either in vivo or in-vitro. This enables also the involvement of a third party in the process of reproduction whether by providing an oocyte, a sperm, an embryo or a uterus. <br>In the Suni Muslim world, the basic guidelines for assisted reproduction are as follows. If ART is indicated in a married coupleas a necessary line of treatment, it is permitted during validity of marriage contract with no mixing of genes. If the marriage contract has come to an end because of divorce or death of the husband, artifical reproduction cannot be performed on the female partner even using sperms of the former husband. Besides, the oocyte and sperm donation are also not allowed because of mixing the genes. In case of Bigamy (in case of marriage of two wifes or more), there was a Fatwa allowing the oocyte or embryo donation within the same family, but this Fatwa was retarded and now even in Bigamy this possibility is not permitted.<br>Conclusion: In Germany there is a law, which was legislated in 1991 which regulates the assisted reproduction technology. The law does not allow the oocyte and embryo donation while sperm donation in case of artificial insemination is allowed. The oocyte and embryo donations are not permitted just because of the possible legal problems which might follow this procedure. But this restriction in the law is not based on the religious or moral issue.</span>
